CCS Stone Terms and Conditions All prices are FOB Moonachie, NJ and do not include taxes or delivery charges unless otherwise stipulated in the CCS acknowledgement.
All quotations are subject to change without notice.
All quotes valid for 30 days. The customer is required to inspect material prior to cutting or installing and assumes full responsibility for material once it is installed, fabricated or handled. CCS Stone is not responsible for labor costs; freight costs or consequential damages associated with stone quality or delivery delays. All sales subject to force majure clause including delays or damages attributed to strikes, accidents, steamship delays, quarry conditions, acts of war or terrorism, power failure, customs and agriculture inspections, or forms of mother nature including extreme weather, earthquake, or flood. CCS may not be held liable for any cause of action resulting from the use of natural stone in any form.
Therefore, CCS makes no express or implied warranty, fitness for particular purpose, and further, limits the implied warranty of merchantability to the industry standards of such goods. As each piece of natural stone varies in its character and color, it also varies in hardness, density and inherent flaws such as veins and fissures.
Any samples submitted are provided with the understanding that the above-mentioned qualities are part of the material and inherent in nature to the product and are not to be considered latent defects or poor quality. Payments shall be made within the time period stipulated by the CCS acknowledgement, any payments that are past due will be assessed a 1 ½% per month late fee. Claims must be made within 3 business days after receipt of goods.
No claims will be accepted on discounted or installed materials.
No goods shall be returned without a prior written return authorization approved by CCS.
Claims may not be filed against goods which invoice is past due.
Past due accounts will be changed to COD on all new transactions. Return subject to 20% restocking fee.
Goods must be returned freight prepaid, and will be subject to warehouse inspection.
Customers are required to return goods in original factory packing.
Adequate protection between pieces and secure wood crating is required to avoid damage in transit and handling.
Returned goods that are not in the original packing or that get damaged due to poor repacking will not be accepted and it will be the customer’s responsibility to file claims with the delivering carrier.
